Terms and conditions of the peljeskovino.eu online shop
Article 1. Introductory provisions and contact
1.1 These terms and conditions (the "terms") govern the sale of the printed book about the wine and food of the Pelješac peninsula (authors Jan Svoboda and Jaroslav Vrba) through the website https://peljeskovino.eu and by e‑mail.
1.2 Seller ("we"):
Pelješko vino s.r.o.
Company ID (IČ) 04943686
registered office Dominikánské náměstí 256/3, 412 01 Litoměřice, Czech Republic
registered in the Commercial Register kept by the Regional Court in Ústí nad Labem (Krajský soud v Ústí nad Labem), Section C, File 37310
e‑mail: peljesko.vino@gmail.com
1.3 Buyer ("you") is anyone who buys from us. If the buyer is a consumer (a person who is not buying in the course of their business), all provisions of these terms apply to them. For buyers who buy as businesses, article 10 also applies, which changes some provisions.
1.4 The publisher of the book is Pelješko vino s.r.o.; for contact details, see point 1.2. Product information (edition, language, ISBN, publisher) is given for each edition on the website.
1.5 We conclude the contract in the language of the website version in which you place your order: Czech, English, German or Croatian.
1.6 Legal relations not governed by these terms are governed in particular by Act No. 89/2012 Coll., the Civil Code (the "Civil Code"), and Act No. 634/1992 Coll., on Consumer Protection.
Article 2. Order and conclusion of the contract
2.1 The presentation of the book on the website is for information and is not an offer to conclude a contract. The offer is your order.
2.2 You see the total price of the order, including shipping, in the order summary before you proceed to payment. This is the amount you pay, and we also state it in the order confirmation, which concludes the contract (point 2.4).
2.3 How to order through the web checkout (the only way of ordering we offer at the moment):
- On the book page you choose the edition, the number of copies, the country of delivery and any options (point 2.5) and click the "Continue to address and payment" button.
- You are redirected to the secure payment page of Stripe. There you enter your e‑mail address, delivery address, telephone number and payment details, confirm that you have read these terms, and check the order summary.
- Until you press the "Pay" button you can correct your details or go back and change the order. By pressing the "Pay" button you send an order with an obligation to pay.
- After a successful payment a thank-you page is shown and we send you an order confirmation by e‑mail straight away.
2.4 The contract is concluded at the moment we deliver the order confirmation to you. If, exceptionally, we could not accept the order (for example because the print run is sold out), we will let you know and refund the amount paid without undue delay, at the latest within 14 days.
2.5 Optional services (we offer them only if they are shown as available for the order):
- authors' signatures - the book will be signed by both authors;
- dedication - the authors write a dedication in the book by hand, in the wording you supply. You are responsible for the content of the text; we may refuse a text that is unlawful or offensive. Note the effect on the right of withdrawal (point 6.8);
- gift - we send the book directly to the recipient, can enclose your message and put no document showing the price into the parcel (we send the document to you by e‑mail);
- purchase for a company - we state the company name, Company ID (IČ) and, where applicable, Tax ID (DIČ) on the document.
2.6 We send you the order confirmation by e‑mail on a durable medium. It includes the text of these terms (as an attachment or in full) and the withdrawal form.
2.7 We archive the contract (your order and our confirmation) in electronic form for its performance, for accounting and for any complaints. We do not make it accessible to third parties, except in the cases set out in the privacy policy.
2.8 The costs of the internet connection or telephone you incur when ordering are borne by you and do not differ from the standard rate.
Article 3. Prices
3.1 The prices of the books are shown for each edition in the order summary. The prices are final and do not change while your order is being processed.
3.2 Currency: for delivery to the Czech Republic you pay in Czech crowns (CZK), for delivery to other countries in euros (EUR). The currency is determined by the country of delivery, not the language of the website.
3.3 Shipping costs are added separately to the price of the books and depend on the country of delivery and the chosen delivery method. The shipping price shown in the order summary when you send the order applies.
3.4 We deliver goods only to the Czech Republic and other countries of the European Union. We do not deliver outside the European Union.
3.5 The price shown at the moment you send the order is decisive, and for an order by e‑mail the price stated in our confirmation. Changes to the price list do not apply to contracts already concluded.
3.6 Discounts: If we announce a discount, we also state, alongside the discounted price, the lowest price at which we offered the book in the last 30 days before the discount (Section 12a of the Consumer Protection Act).
3.7 Prices are not personalised on the basis of automated decision-making.
Article 4. Payment
4.1 Online payment. You pay by card or by another instant payment method offered to you by the Stripe payment page (for example Apple Pay, Google Pay). The payment is processed by Stripe Payments Europe, Ltd.; we neither see nor store your card details. The amount is charged when you send the order. Any conversion into another currency is made by the issuer of your card under its terms.
4.2 We offer neither cash on delivery nor cash payment.
4.3 We send you the proof of purchase by e‑mail.
Article 5. Delivery
5.1 Where we deliver: to the countries we offer when you order the book; you choose the country of delivery there.
5.2 Carriers: in the Czech Republic Česká pošta, s.p. (registered post) or Zásilkovna s.r.o. (Packeta); to other countries via a parcel or postal service commonly used in the country concerned. We state the specific delivery method in the order confirmation.
5.3 When we dispatch the book: within 2 working days of the conclusion of the contract. Usual transport time: Czech Republic 1–3 working days, other EU countries 5–10 working days; transport times are indicative and depend on the carrier. We deliver only to the Czech Republic and other countries of the European Union. Unless we agree otherwise, we deliver the goods no later than 30 days after the conclusion of the contract. For a signed copy, with or without a dedication, the dispatch period is extended by one working day.
5.4 We inform you of the dispatch by e‑mail, including the parcel tracking number, if available.
5.5 Passing of risk: If the buyer is a consumer, the risk of loss of or damage to the goods passes to them at the moment they or a person designated by them (for example the recipient of a gift), not the carrier, receive the goods. Until then the seller bears the risk of loss or damage in transport. For businesses see point 10.4.
5.6 Damaged parcel: Please check the packaging when you receive the parcel. If it is visibly damaged, you can refuse the parcel or have the damage recorded by the carrier. In any case, write to us as soon as possible, ideally with a photo - it helps us send a replacement quickly. Your statutory rights (article 7) are not limited in any way by this.
5.7 If, without reason, you do not accept the parcel and it is returned to us, we will contact you. If we resend it, we may ask you to pay the new postage.
5.8 We do not offer personal collection.
Article 6. Withdrawal from the contract (returning goods within 14 days)
6.1 If you are a consumer, you have the right to withdraw from a contract concluded at a distance within 14 days without giving any reason. The period starts on the day on which you acquire, or a third party other than the carrier and indicated by you (for example the recipient of a gift) acquires, physical possession of the goods. If we deliver the order in several parcels, the period runs from the day on which the last of them is received. You may also withdraw before you receive the goods.
6.2 How to withdraw. It is enough to send us an unequivocal statement within this period: online with the "Withdraw from contract here" button on the Withdrawal from the contract page (the link is also in the website footer and in the e-mails about your order), by e‑mail to peljesko.vino@gmail.com or by letter to the address of our registered office (point 1.2). Online you enter the order number, e‑mail, name and the books the withdrawal concerns (you do not have to give a reason), and send the withdrawal with the "Confirm withdrawal" button. You may use the model withdrawal form, which is annexed to these terms and which we also send with the order confirmation, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your statement before the withdrawal period has expired. We will send you an acknowledgement of receipt of your withdrawal by e‑mail without delay, including its content and the date and time of receipt. The full text and the form are also on the Withdrawal from the contract page.
6.3 Returning the goods. Send the goods back to us not later than 14 days from your withdrawal, to: Pelješko vino s.r.o., Dominikánské náměstí 256/3, 412 01 Litoměřice, Czech Republic. Please do not send the books back cash on delivery.
6.4 You will have to bear the direct cost of returning the goods (usually the postage). A book fits into an ordinary postal parcel.
6.5 Reimbursement. We shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we receive your withdrawal. If you chose a type of delivery other than the least expensive type of delivery offered by us, we reimburse the costs of delivery only up to the cost of the least expensive type. We will carry out the reimbursement using the same means of payment as you used (automatically back to the card you paid with), unless we expressly agree otherwise; in any event, you will not incur any fees as a result of such reimbursement.
6.6 We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
6.7 You are liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature and characteristics of the goods (for a book, for example, pages written on or damaged). We may set off a claim for compensation for such damage against the amount reimbursed.
6.8 Book with a dedication. A dedication written in the wording you supplied means that the goods have been adapted to your wishes and for you personally. For copies adapted in this way you therefore cannot withdraw from the contract (Section 1837(d) of the Civil Code). We point this out to you when you choose the dedication, before you send the order. The exception concerns only copies with a dedication; for copies with the authors' signatures only (without a personal text) and for the other books in the same order, the right of withdrawal remains. Your rights in respect of defective performance (article 7) are not affected.
6.9 We may withdraw from the contract if the book cannot be delivered because the print run is sold out. In that case we will reimburse everything you have paid without undue delay, at the latest within 14 days.
6.10 A buyer who buys as a business does not have the right to withdraw under this article (article 10).
Article 7. Rights in respect of defective performance (complaints)
7.1 We are responsible for the book having no defects when you receive it: it corresponds to the description (edition, language, extent), is complete (no pages missing or bound twice), is not damaged and is fit for its usual purpose.
7.2 Period: You can make a complaint about a defect that appears within 24 months of receiving the book. If the defect appears during the first year after receipt, the book is presumed to have been defective already on receipt, unless the nature of the item or of the defect rules this out.
7.3 How to make a complaint. Write us an e‑mail to peljesko.vino@gmail.com or a letter to the address of our registered office. State the order number, a description of the defect (ideally with a photo) and the remedy you request. If we ask you to, send us the book to the address Pelješko vino s.r.o., Dominikánské náměstí 256/3, 412 01 Litoměřice, Czech Republic; we will reimburse the postage for sending the book if the complaint is justified.
7.4 Your rights:
- You can request delivery of a new book (replacement) or removal of the defect. For a book the usual remedy is replacement with a new copy. We may refuse the chosen remedy if it is impossible or disproportionately costly compared with the other.
- You can request a reasonable discount or withdraw from the contract if we refuse to remove the defect or do not remove it within a reasonable time or without considerable inconvenience to you, if the defect appears repeatedly, if the defect is a material breach of the contract, or if it is clear from our statement or the circumstances that we will not remove the defect. You cannot withdraw from the contract for a minor defect.
7.5 Confirmation and handling. When you make a complaint, we confirm to you by e‑mail when you made it, what it contains and which remedy you request. We handle the complaint no later than 30 days after you make it, unless we agree on a longer period. We send you a confirmation of the date and manner of handling, including the reasons where we reject the complaint. If we do not meet this deadline, you can withdraw from the contract or request a reasonable discount.
7.6 You have the right to reimbursement of the costs reasonably incurred in connection with a justified complaint (for example postage).
7.7 You have no rights in respect of defective performance if you knew about the defect before receipt or if you caused the defect yourself. For a book with a dedication, the handwriting or style of the dedication is not a defect if it corresponds to your instructions.
7.8 This article is also our complaints procedure.
Article 8. Out-of-court dispute resolution and complaints
8.1 We handle complaints and questions at the e‑mail address peljesko.vino@gmail.com. We try to resolve them amicably and quickly.
8.2 If you are a consumer and we do not manage to resolve a dispute by agreement, you can file a proposal for out-of-court resolution of a consumer dispute with the Czech Trade Inspection Authority (Česká obchodní inspekce):
Česká obchodní inspekce, Ústřední inspektorát - oddělení ADR (Central Inspectorate - ADR Department)
Gorazdova 1969/24, 120 00 Praha 2
e‑mail: adr@coi.gov.cz
web: https://coi.gov.cz/informace-o-adr/
You can file the proposal no later than 1 year after the day on which you first asserted against us the right that is the subject of the dispute.
8.3 Consumers from other EU countries can also contact the European Consumer Centre in their country (in Czechia https://www.evropskyspotrebitel.cz).
8.4 Compliance with the obligations under the Consumer Protection Act is supervised by the Czech Trade Inspection Authority (www.coi.gov.cz), and in the area of personal data protection by the Office for Personal Data Protection (Úřad pro ochranu osobních údajů, www.uoou.gov.cz).
Article 9. Personal data protection
9.1 We process personal data to the extent necessary for the conclusion and performance of the contract, for keeping accounts and for the other purposes described in the Privacy policy.
Article 10. Business buyers (B2B)
10.1 This article applies to buyers who buy the book in the course of their business (for example a wine shop, a club, a travel agency) and state their Company ID (IČ). Stating a Company ID does not in itself mean that the buyer is acting as a business; the purpose of the purchase is decisive.
10.2 A business buyer does not have the right to withdraw from the contract without giving any reason under article 6.
10.3 A business buyer must inspect the goods as soon as possible after receiving them and notify us of defects without undue delay after discovering them or after they could have been discovered by a timely inspection, at the latest within 6 months of receipt. The 30-day period, the presumption under point 7.2 and the provisions on confirming a complaint do not apply to them; we handle the complaint within a reasonable time.
10.4 The risk of loss of or damage to the goods passes to a business buyer when the goods are handed over to the first carrier.
10.5 For larger purchases (6 or more copies) we can agree an individual price and conditions; such an agreement takes precedence over these terms.
10.6 Our liability to a business buyer for damage is limited to the price of the order, except for damage caused intentionally or through gross negligence and for personal injury.
10.7 The application of the United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention) is excluded. Disputes are decided by the court having local jurisdiction for the seller's registered office.
10.8 The terms and conditions of a business buyer do not apply unless we expressly accept them in writing.
Article 11. Final provisions
11.1 The contract is governed by Czech law. If you are a consumer with your residence in another state, you do not thereby lose the protection afforded to you by the mandatory provisions of the law of the state of your residence.
11.2 If you are a consumer, you can bring proceedings before the court where you reside or where we have our registered office.
11.3 We may change these terms. A change does not apply to contracts concluded before it takes effect: your order is always governed by the version of the terms in effect on the day you send the order. We archive all versions and will send them to you on request.
11.4 If any provision is invalid, the other provisions remain in force.
11.5 Annexes: model withdrawal form (see also Withdrawal from the contract).
11.6 These terms (version 1.7) are effective from 15 October 2026 and replace the General Terms and Conditions effective from 21 February 2017.
Annex: Model withdrawal form
